劳资关系冲突是中国经济转型中日益突出的问题。劳动者在劳动争议中胜诉的比率体现着劳动者权利和权益得到保护的程度。随着劳动力资源配置逐步市场化,政府对劳动争议的处理,逐步从单一的劳动者权益保护向双方利益调节的方向改变。文章计量分析了经济发展水平、经济增长速度、社保就业支出、公有部门就业比重等因素对劳动者胜诉率的影响。结果显示,地方经济发展水平、经济增长速度对劳动者胜诉的影响程度最大。地方经济发展水平越高、经济增长速度越快,劳动者胜诉的几率越小,而劳资双方部分胜诉的几率有所提高,说明地方政府对劳动者权益的保护相对不足。这种有偏向的裁决方式,将影响我国劳动力市场的发育。
The conflict between labor and capital relations is an increasingly prominent issue in China’s economic restructuring. The ratio of laborers who win the labor dispute reflects the extent to which workers’ rights and interests are protected. With the gradual marketization of labor resources allocation, the government’s handling of labor disputes gradually changes from protecting the rights and interests of workers to adjusting the interests of both parties. The econometric analysis of the level of economic development, economic growth, social security employment expenditure, the proportion of public sector employment and other factors on the prevalence rate of workers. The result shows that the level of local economic development and the speed of economic growth have the greatest impact on the success of laborers. The higher the level of local economic development, the faster the economic growth, the less likely the worker will succeed in winning a lawsuit and the higher the chances of partial success of both the employer and the employee, indicating that the protection of the rights and interests of laborers by the local government is relatively inadequate. This biased decision will affect the development of the labor market in our country.
