自诉案件是指被害人及其法定代理人、近亲属,为追究被告人的刑事责任,而直接向人民法院提出诉讼的案件。重婚被列为被害人有证据证明的轻微刑事案件,考虑的是此罪对社会安全危害的程度,而忽视了对社会公民道德建设的影响。本文结合当前我国道德现状进行论述,分析重婚列为自诉案件之不足。再者家庭是构成社会的最基本的细胞,家庭的稳定与否势必影响道德观念的形成,进而影响人们的道德价值取向和社会公民道德的建设。由此,在社会转型期,把重婚列为公诉案件更有利于我国社会公民道德建设。
Private prosecution cases refer to cases where victims and their legal representatives and close relatives directly bring litigation to the people’s court in order to investigate the defendant’s criminal responsibility. Bigamy is classified as a minor criminal case where the victim has evidence to prove that the crime is considered to be harmful to social safety and neglects the impact on the moral construction of social citizens. This article discusses the current situation of morality in our country and analyzes the problem of bigamy as a case of private prosecution. Furthermore, the family is the most basic cell that constitutes the society. The stability of the family will inevitably affect the formation of moral concepts and thus affect people’s moral values and the construction of social civic morals. As a result, in the social transition, the bigamy as a public prosecution case is more conducive to China’s social ethics.
