由于学界研究视野的地方转向,对清代地方档案的研究越发受到人们的重视。现存较完整的西和县档案,涵盖内容较为全面,时间跨度较长,涉及地方史实较多,蕴含着丰富的史料价值,为研究基层社会的结构组织提供了良好的参考素材。本文以西和县清代司法档案中的田土、盗窃案件为观察视角,通过仔细梳理案件详情,以案件的具体审判过程为切入点,全面探究从提供告诉状,出具证供,再到传唤、批呈等审判程序,试图厘清清代州县解决民间纠纷的基本思路,包括判案依据、解决方式以及审判结果等,同时进一步研究影响民间纠纷告上衙门的因素,从而深入了解地方社会细故纠纷背后所隐匿的经济原因。
