本文从中国的法律和传统的关系出发,对陇县人民法院能动主义八四司法模式的原因进行探索,认为这是我国目前以司法机关与社会进行互动形式下的民间伦理的一种非制度性填充或是表达,对于目前我国的法治建设具有促进作用。并且利用博弈论对这种模式的规制作出阐述,最后通过对于负效应的分析,提出这种非常态的模式的风险预估和发展趋向。
This article, starting from the relationship between law and tradition in China, explores the reasons why the Long County People’s Court has adopted the “August 4th” judicial model of the judiciary and considers it as a kind of non-institutional nature of the folk ethics in the current form of interaction between the judiciary and society Fill or express, for the current construction of the rule of law in our country has a catalytic role. And the use of game theory to elaborate on the regulation of this model, and finally through the analysis of the negative effects, put forward the risk prediction and development trend of this abnormal mode.
