来信咨询请问工伤认定申请是否有时间限制,作为用人单位,应当何时提出工伤认定为好,如果超出时限会有哪些不利后果?劳动者发生事故伤害或者按照《职业病防治法》的规定被诊断、鉴定为职业病,所在用人单位应当自事故伤害发生之日或者被诊断、鉴定为职业病之日起30日内,向所在工商登记注册地的区、县人力资源和社会保障行政部门提出工伤认定申请。如果用人单位没有在规定时间内提出工伤认定申请,从业人员或者其近亲属、工会组织,则可以在事故伤害发生之日或者被诊断、鉴定为职业病之日起1年内,直接向用人单位所在地的区、县人力资源和社会保障
