支票是银行的存款人签发给收款人办理结算或委托开户银行将款项支付给收款人的票据。支票在同一城市或一定的区域范围内,可以用于商品交易,劳务供应,清偿债务等款项的结算。中国人民银行于 1988年12月19日颁发《银行结算办法》(银行[1988」391号)中的第二章第十六条中对支票的使用和管理作出了十款具体规定。同时也规定:“单位和个人办理结算,由于填写结算凭证有误,影响资金使用,票据和印章丢失造成资金损失的,由其自行负责。(见上文中第三章第二十一条)此外,还规定:“银行办理结算因工作差错,发生延误,影响客户和他行资金使用的,应按存(贷)款的利率计付赔偿金……”。(同上文第三章第二十四条)。
