中国经济体制改革研究会会长高尚全认为,狭义的垄断在法律上是指特定的主体在特定市场上的特定经济活动中排除或者限制竞争者的状态或行为。也就是说在特定市场内的市场主体追求最大的垄断利益,或滥用政府赋予的权力,或利用特许经营权,或者与其他经营者合谋,垄断市场、垄断价格,排斥其他经营者进入同业市场,从而损伤消费者权益,违反公共利益的行为。
Gao Shangquan, president of China’s Economic System Reform Association, argues that narrowly defined monopoly means that a legal entity excludes or restricts the status or conduct of competitors in a particular economic activity in a particular market. In other words, the main market entities in a particular market pursue the maximum monopoly interests, abuse the power conferred by the government, or use the franchise or collude with other operators to monopolize the market, monopolize prices and exclude other operators from entering the interbank market. Thus damaging consumers’ rights and interests and violating the public interest.
