在经济全球化的背景下,完善的植物知识产权保护制度是现代农业发展和繁荣的必然要求。转基因植物特殊性对现代法律制度提出了巨大挑战,而我国在构建完善的转基因植物知识产权保护体系上仍有很长一段路要走。本文旨在分析我国目前的立法现状,进而对我国转基因植物的知识产权法律保护提出改进建议。一、我国转基因植物知识产权保护的现状及缺陷(一)我国转基因植物知识产权保护的相关法律规定1、专利法律制度相关规定
Under the background of economic globalization, a sound system of plant intellectual property protection is a necessary requirement for the development and prosperity of modern agriculture. The particularity of transgenic plants presents a great challenge to the modern legal system. However, China still has a long way to go in building a sound system for the protection of intellectual property of transgenic plants.
