惩罚性赔偿在知识产权法中的应用

当今时代,知识经济迅猛发展,人们的知识产权意识越来越明显,随之而来的知识产权侵权问题也日益严重,尽管我国的司法体系日趋完善,但在知识产权法的建立上仍然存在一定的缺陷,给产权拥有者带来很大的困扰和损失。本文笔者通过研究我国知识产权的特点和现状,来论述在知识产权法中引进惩罚性赔偿的必要性,提出知识产权法中引进惩罚性赔偿的具体落实。

In today’s era, with the rapid development of knowledge economy, people’s awareness of intellectual property becomes more and more obvious, and the problems of infringement of intellectual property rights have also become increasingly serious. In spite of the increasingly perfect judicial system in our country, there still exists certainty in the establishment of intellectual property law The defects bring great disturbance and loss to the owners of the property rights. The author of this paper studies the characteristics and current situation of intellectual property in China to discuss the necessity of introducing punitive damages in intellectual property law and proposes the concrete implementation of the introduction of punitive damages in intellectual property law.
