1997年7月3日我国加入了海牙《关于从国外调取民事或商事证据的公约》,该公约是迄今为止民商事域外取证方面最为完善的多边公约。公约应需而订,对海牙1954年《民事诉讼程序公约》中域外取证部分进行了修订,完善了嘱托书制度,扩大了外交领事代表取证的权力,引进了特派员取证制度,更有利于各国尤其是大陆法系国家和英美法系国家之间的合作。本文在评介公约主要内容的同时,指出了我国在适用该公约时应注意的若干问题
On July 3, 1997, China acceded to The Hague, “Convention Concerning Evidence Retrieving Civil or Commercial Abroad,” which is by far the most comprehensive multilateral convention on forensic extradition of civil and commercial affairs. The convention needs to be revised to amend the part of extra-territorial forensic evidence in the 1954 Civil Procedure Convention of The Hague, improve the exhortation system, expand the power of diplomatic and consular representatives to obtain evidence, and introduce the system of forensic examiners, which is more beneficial to all countries Especially the civil law countries and Anglo-American countries. While reviewing the main contents of the Convention, this article points out several issues that our country should pay attention to when applying this Convention
