针对中国即将加入ＷＴＯ这一形势 ,就完善我国《商标法》及其《实施细则》提出以下几个方面的建议 :改终局评审制度为评审后的司法复审制度 ;修订完善《实施细则》第 2 5条 ,明确“在先权利” ;完善被撤销注册商标的溯及力问题 ;解决《商标法》与其《实施细则》在“民告官”程
Aiming at the situation of China’s imminent accession to the WTO, the following suggestions are made on how to perfect the “Trademark Law” and its “Detailed Rules for Implementation” in our country: Reviewing the system of final approval as the judicial review system after the review; Revising and perfecting the Regulations 2 5, clear “prior right”; improve the revocation of registered trademarks of the retrospective problem; resolve the “Trademark Law” and its “Regulations” in the “people sue official” process
