改革开放以来,中国的劳动法制在不断发展,劳动法理念也随之产生并不断创新,从传统的劳动法理念发展到现代的劳动法理念,以私法理念修补传统的国家干预理念,以合作理念修补传统的对抗观念,以劳动自由、劳动自治理念修正传统的行政干预理念。并分析了传统的劳动法理念的缺点以及新的劳动法理念的优点。劳动法理念的创新有利于缓解资本与劳动利益的矛盾,实现保障劳动者利益与促进资本经济的发展。
