高校纪律处分是高校在管理学生过程中通常使用的手段,《高等教育法》、《普通高等学校教育管理规定》等规章制度对高校行使此种权力有明确规定。然而,近些年,高校与学生因纪律处分的纠纷屡见不鲜。随着依法治国的深入,依法治校也是应有之义。如何在法律的框架内,正确把握高校的管理权限,合法、有效的行使管理职责,有理有据的对学生进行纪律处分,这是高校管理者的当务之急。
Disciplinary action at colleges and universities is commonly used by colleges and universities in the management of students. The rules and regulations such as the Law on Higher Education and Regulations on the Administration of General Higher Education contain clear stipulations on the exercise of such powers by colleges and universities. However, in recent years, disputes between universities and students due to disciplinary sanctions are not uncommon.
