立法协商是社会转型期回应社会需求的必然选择,它有利于增强法律的科学性、针对性和效益性。当前,立法协商还存在着环境影响下的参与不足、目标分化下的利益之争和制度缺陷下的规则紊乱等问题。有效推进立法协商发展,需要从三个方面努力:一是建立科学合理的协商体制,从环境保障上构筑政治参与的有力支撑;二是树立共赢博弈的价值理念,从目标愿景上开启化解利益争夺的动机之窗;三是建立制度化的程序规范,从运行机制上确保“产品”的经济效益。
Legislative consultation is an inevitable choice to respond to the needs of the society during the social transition. It is conducive to enhancing the scientific nature, pertinence and effectiveness of the law. At present, there are still issues such as the lack of participation under the influence of the environment, the conflict of interests under the goal differentiation and the disorder of rules under the system defects in the legislative consultation. To effectively promote the development of legislative consultation, efforts need to be made in three aspects. First, to establish a scientific and rational consultation system and to build a strong support for political participation from environmental protection. Second, to establish the value concept of a win-win game and to resolve the interests of the target. The third is to establish the procedural norms of the system, from the operating mechanism to ensure “product ” economic benefits.
