第一章總則第一條根據中華人民共和国憲法第一百零三條「保衛祖國是中華人民共和國每一個公民的神聖職責。依照法律服兵役是中華人民共和国公民的光荣義務。」的規定,制定本法。第二條中華人民共和國年滿十八歲的男性公民,不分民族、種族、職業、社會出身、宗教信仰和教育程度,都有義務依照本法的規定服兵役。
