近年来,我国的食品安全形势不容乐观,每年在全国范围内都会爆发多起食品安全事故。能否吃到放心的食品是广大消费者都非常关切的社会问题。食品安全是关系国计民生的重大问题,对人民的生命健康造成极大损害。事件的频繁发生主要与食品生产经营者的不法行为有关,但另一个方面也反映了我国食品安全行政监管的薄弱,主要表现为食品安全行政责任法律规定不完善、食品安全监管行政机关及其工作人员的行政责任追究不到位。目前我国国内食品安全中的责任研究大多是从生产经营者的民事赔偿及食品安全行政监管体制这些方面进行,较少有从食品安全的行政责任这一方面进行研究的。基于以上原因,加强食品安全行政监管是落实行政法治一个刻不容缓问题。
In recent years, the food safety situation in our country is not optimistic. More than one food safety accident broke out each year across the country. It is a social issue that consumers are concerned about whether they can eat the food they are worried about. Food safety is a major issue concerning the national economy and the people’s livelihood, which has caused tremendous damage to people’s lives and health. The frequent occurrence of incidents is mainly related to the wrongful conduct of food producers and operators, but another aspect also reflects the weakness of food safety administrative supervision in our country, which is mainly manifested in the imperfect legal provisions of food safety administrative responsibility, the food safety regulatory agencies and their work Personnel administrative responsibility is not in place. At present, most researches on the responsibility of food safety in our country are conducted from the aspects of civil compensation of producers and traders and the food safety administrative supervision system. Few researches are made on the administrative responsibility of food safety. For these reasons, strengthening food safety administrative supervision is an urgent issue in implementing the administrative rule of law.
