企业内部举报人因举报行为经常遭受解雇、降职等企业报复行为,迫切需要劳动法提供有效保护。目前我国劳动法对企业内部举报人的保护限于零散规定,存在保护范围窄、缺乏针对性的救济手段、与劳动者忠诚义务有冲突等问题。今后可从增设专门的企业内部举报人保护条款、改进救济与处罚措施、平衡企业内部举报人保护与劳动者忠诚义务的关系等方面完善我国劳动法对企业内部举报人的保护。
Internally, whistleblowers often suffer retaliatory acts such as dismissal and demotion of their employees for reporting acts. There is an urgent need for labor laws to provide effective protection. At present, the protection of inhuman informants in China’s labor law is limited to fragmented regulations, with the problems of narrow scope of protection, lack of targeted remedies and conflict with workers’ loyalty obligations. In the future, we can improve the protection of whistleblowers in our country from the aspects of protecting the provisions of whistle-blowing insiders, improving remedies and sanctions, and balancing the relationship between whistleblower protection and employee loyalty obligations.
