刑法解释是对刑法规定意义的说明,使刑法具有生命力。由于过多的刑法定义会是法律过于僵化,所以,法律中的定义都是危险的,法律是简洁的。但是,社会生活又是复杂的,需要使用法律的案件也是复杂的,因此,制定法律时,立法者不得不作出一种并不适用于所以案件而是适用于大多数案件的普遍规定。这就出现了问题:当少数案件难以在法条中找到完全合适且确切的位置,但是不处罚又有违正义时,司法者该如何取舍?是放任罪犯;还是用刑法的智慧进行解释?我想后者才是
The interpretation of criminal law is an explanation of the meaning of the criminal law, making the criminal law vitality. Since too much definition of criminal law would be overly rigid in law, the definition of law is dangerous and the law is simple. However, social life is complicated and cases involving the use of law are complex. Therefore, in formulating laws, legislators have to make a general provision that does not apply to all cases but to most cases. This raises the question of how the judiciary should choose when it is difficult to find a perfectly suitable and exact place in the law in a few cases, whether to allow criminals, or to interpret it with the wisdom of criminal law, and I Think of the latter
