中文法学论文的英译是宣传中国法学家研究成果的窗口,体现了中国法学研究的热点、难点和前沿议题,也呈现了中国法学家的研究方法和研究水平。本文以2011年《中国法学》(海外版)第1至2期共140篇英译稿和中文文本为研究对象,在共时层面,基于功能主义翻译观,分析了论文正文中小标题以信息功能为主、表情和感染功能为辅的特点,主张小标题中译英以功能对等、传意翻译策略为主,兼顾直译和语意翻译策略。
English translation of Chinese legal essay is a window to promote the research results of Chinese jurists. It reflects the hot spots, difficulties and frontier issues of Chinese Jurisprudence research as well as the research methods and research level of Chinese jurists. In this paper, 140 English translations and Chinese texts of the first two issues of Chinese Law (Overseas Edition) in 2011 are taken as research objects. Based on the synchronic level, based on the functionalist translation perspective, this paper analyzes the effect of information function Mainly, facial expression and infection, supplemented by the characteristics of the subtitle that advocates functional equivalence, the main purpose of translation strategy, taking into account both literal translation and semantic translation strategies.
