高校有无处分学生的权力?这种处分权具有何种法律性质?如何对之加以控制与救济?伴随着我国法治化进程的逐步推进,高校对学生的管理越来越受到人们关注。高校享有对学生的处分权、但其法律性质应当被界定为一般行政行为,并应当逐步纳入法治化的轨道。作者的观点引发我们对高校法治化建设的进一步思考。
How to control and remedy? With the gradual progress of the rule of law in our country, the management of students in colleges and universities has attracted more and more attention. Colleges and universities have the right to dispose of students, but their legal nature should be defined as a general administrative act, and should be gradually incorporated into the track of the rule of law. The author’s point of view leads us to think further about the legalization construction of colleges and universities.
