CISG(以下简称《公约》)是目前国际货物销售合同领域一部最重要的国际统一实体法,在世界范围内受到广泛推崇。《公约》第95条作为《公约》第1条第1款b项的保留条款,肯定了保留国排除适用公约的保留效果但没有详细规定保留效果的实现方式,当今国际社会也尚缺乏统一的保留效果实现标准,这使得在存在保留国时,公约的适用呈现不确定和不统一的状态,这制约了公约的进一步发展。基于此,本文通过探讨相对合理的保留效果实现标准,分析了存在保留国时的公约的适用情形,以完善公约的适用,促进公约的发展。
CISG (hereinafter referred to as the “Convention”) is the most important international entity law in the field of international sales of goods and is widely respected around the world. Article 95 of the Convention, as a reservation to article 1, paragraph 1 (b) of the Convention, affirms the way in which the reserving State ruled out the effect of the reservation to the applicable convention but does not specify the effect of the reservation, and there is a lack of uniformity in the international community today The criteria for the implementation of the reservation effect have made the application of the Convention unfounded and inconsistent in the presence of the reserving State, which has constrained the further development of the Convention. Based on this, this paper analyzes the application of the Convention in the Presence of the Preserving Countries by probing into the relatively reasonable standard of the effect of the reservation to improve the application of the Convention and promote the development of the Convention.
