刑事附带民事诉讼制度是当代中国法制进步的重要标志之一。“刑附民”精神损害赔偿制度是社会生产力发展的必然要求,市场经济的迅速发展深刻改变着人们思想观念,为制定该制度奠定了广泛的思想基础。“刑附民”精神损害赔偿制度是构建和谐社会的题中之义,是全面保障人权的必然要求。被害人对精神损害赔偿的请求是公民的一项基本人权和维护其合法权益的一种手段,亦即公民应当依法享有提出精神损害赔偿的权利。刑事附带民事诉讼制度在确立和实施,在我国已经取得了较好的成效,在即将启动的刑事诉讼法再修改过程中纳入这一制度,正逢其时。
The criminal incidental civil procedure system is one of the most important symbols of the progress of the legal system in contemporary China. The system of compensation for the mental damage of the criminal attached to the people is an inevitable requirement for the development of social productive forces. The rapid development of the market economy has profoundly changed people ’s thinking and laid a broad ideological foundation for the formulation of the system. “Penalty attached to the people ” spiritual damage compensation system is the meaning of building a harmonious society, is a necessary requirement for the full protection of human rights. The victim’s request for compensation for moral damages is a basic human right of citizens and a means of safeguarding their legitimate rights and interests. That is, citizens should enjoy the right to make compensation for moral damages according to law. The system of criminal incidental civil action is being established and implemented and has achieved good results in our country. It is time to introduce this system into the upcoming revision of the criminal procedure law.
