第一条根据中国人民政治协商会议共同纲领第廿五条精神,本府为表扬在革命战争中阵亡或为革命捐躯之烈士并抚卹和优待其遗属起见特制定本条例。第二条凡在革命战争中阵亡或在革命斗争中而牺牲之烈士遗属,(包括大革命苏维埃抗日与解放战争各个时期内之主力军地方部队游击队民兵及党政人员地下工作者在内)如有确证及县级以上负责同志或区以上机关证明者,均得享受本条例之待遇。第三条本条例所称烈属以烈士本人之直系亲属(父母配偶子女与十六岁以下之弟妹)为限,如其配偶已再婚者,不得享受本条例之优待。
Article 1 In accordance with the spirit of Article 25 of the Common Program of the Chinese People’s Political Consultative Conference, the government enacted these Regulations in recognition of the martyrs killed or sacrificed for the revolution in the revolutionary war and for the pensions and treatment of their survivors. Article 2 All survivors of the martyr who died during the revolutionary war or who died during the revolutionary struggle (including the main army local army guerrillas and underground workers of party and government personnel during various periods of the Anti-Japanese War of Liberation and the War of Liberation) Those who are affirmative and who are responsible for comrades above the county level or above the district level shall enjoy the treatment of these Regulations. Article 3 The majesty referred to in these Regulations shall be limited to the immediate relatives of martyrs (children of parents and spouses and siblings under the age of 16), and shall not enjoy the preferential treatment of this Ordinance if their spouses are remarried.
