许多从事国际刑事司法研究和实务工作的人士,包括为国际刑事法院工作的人员,都宣称国际刑事法院具有吓阻力,且有能力剥夺国际刑事违法行为人的豁免权。这些人通常假定了国际刑事法院具有强力吓阻效果的可能性。但是,鉴于21世纪危害人类罪的日益高涨,上述主张仅是充满希望的宣告而已。文章立基于犯罪学视角及其解释,主要检视了国际刑事法院对国际刑事违法,尤其是违反国际人道主义法的行为的潜在抑制效力。为此,我们展示了当前吓阻理论的研究状态,并评估其能否产生以及如何产生前述人士及国际刑事法院自身所认定的实效。
Many of those engaged in international criminal justice research and substantive work, including those working for the International Criminal Court, have declared the International Criminal Court as threatening and capable of depriving international criminals of their immunity. These people often assume the possibility that the International Criminal Court has a strong deterrent effect. However, given the increasing crimes against humanity in the 21st century, the above claims are only promising announcements. Based on the perspective of criminology and its interpretation, the essay mainly reviews the potential restraining effect of the International Criminal Court on international criminal law violations, especially violations of international humanitarian law. To that end, we present the current state of research on deterrence theory and assess its ability to produce and how it has been validated by the aforementioned individuals and the ICC itself.
