《婚姻法》第40条本质上是对家庭劳动价值的认可,且该补偿并非离婚分割共同财产时的考虑因素,而是一种独立的诉讼请求权。该规定符合我国社会现状,一定程度上保障了为家庭付出而在经济上处于弱势地位一方的利益,最主要女性的利益。但同时又存在很多不足的地方,比如该规定适用的前提时夫妻双方采取分别财产制、离婚时才可以提出家务劳动补偿等。本文将重点剖析《婚姻法》第40条的不足之处,提出对于我国家务劳动经济补偿制度的思考。
Article 40 of the Marriage Law is essentially an endorsement of the value of family labor, and the compensation is not a consideration in dividing divorce from common property, but an independent right to claim. This provision is in line with the current social situation in our country and to some extent guarantees the interests of the family, economically disadvantaged, the most important female. However, at the same time, there are still many deficiencies. For instance, when both the husband and wife adopt separate preconditions, the property rights system should be adopted and the compensation for housework can only be provided when a divorce occurs. This article will focus on analyzing the shortcomings of Article 40 of the Marriage Law and put forward some thoughts on the economic compensation system for domestic labor.
