相同位阶民事法律冲突是我国民事审判实践中的固有难题,对于具体的适用问题,至今尚未有具体的法律法规给出全面、统一的方法指导。本文从一起典型的海上涉外人上身伤亡损害赔偿案件的审理入手,按照法律适用的逻辑步骤和一般规则,分析演练了想同位阶民事法律规范冲突时的法律适用方法。
The conflict of civil law of the same rank is an inherent problem in the practice of civil trial in our country. So far, no specific laws and regulations have yet been given to provide comprehensive and unified methodological guidance on the specific applicable issues. This article begins with the trial of a typical case of damages for the injury or death of the body and body of a foreigner at sea.
