近年来,随着农村经济的发展,传统农业向现代农业的转型,以及农村劳动力就业向第二、第三产业和城镇的转移,土地承包经营权流转出现加速和呈现适度规模经营的趋势。当前,物权法以及国家农村土地承包新政策已经出台,但是农村土地承包方面出现了很多问题,成为国家的热点问题。本文主要通过分析当下农村土地流转的现状以及相关法律制度和实践中的缺陷,结合建设社会主义新农村的实际提出切实可行的意见。
In recent years, with the development of rural economy, the transition of traditional agriculture to modern agriculture and the transfer of rural labor force to the secondary and tertiary industries and towns, the flow of land contractual management right has shown a tendency of accelerating and showing moderate scale operation. At present, the Property Law and the new rural land contract policy have been promulgated, but there have been many problems in rural land contract and have become a hot issue for the country. This paper analyzes the current status of rural land transfer and the defects of the relevant legal system and practice, and puts forward practical opinions in light of the actual conditions of building a new socialist countryside.
