为加强上海市房地产权属管理,维护房地产市场秩序,保障房地产权利人的合法权益,上海市第十届人民代表大会常务委员会第23次会议通过了《上海市房地产登记条例》,并从1996年3月1日起实施。根据《条例》的要求,有关部门对本市行政区域内的房地产进行了登记,并将房、地两证合一,由上海市房屋土地管理局统一制作、颁发《房地产权证》。 由于本市房地产登记的内容广泛,登记后形成的档案内容较复杂,给房地产登记档案的整理归档带来一定的困难。本刊特邀请上海市房屋土地管理局档案馆的沈志能同志,就上海市房地产登记档案涉及的范围,以及整理归档的有关注意事项,作一些初步的解答。
In order to strengthen the management of real estate ownership in Shanghai, safeguard the order of the real estate market and protect the legitimate rights and interests of real estate owners, the 23rd meeting of the Standing Committee of the Tenth Shanghai Municipal People’s Congress adopted the Shanghai Real Estate Registration Regulations, and from 1996 March 1 implementation. According to the requirements of the “Regulations”, the relevant departments registered real estate in the administrative area of the municipality, combined the two certificates of housing and land, and unifiedly produced them by the Shanghai Municipal Bureau of Land and Resources, promulgating a “real estate warrant.” Due to the wide range of real estate registrations in the municipality, the contents of the archives formed after registration are complicated, which brings some difficulties to the filing and filing of real estate registration archives. This article has invited Shanghai Housing and Land Administration Archives, Comrade Shen Zhineng, Shanghai real estate registration files related to the scope, as well as organize the filing of the relevant matters for consideration, make some preliminary answers.
