土地关系到人们的生存,决定了社会的发展。当前,法制社会的发展步伐越来越快,土地发展权作为保障土地发展的主要法律载体,对维护土地具有十分重要的现实意义。那么土地发展权法律制度是如何实现的,在构建中存在哪些问题呢?由姚昭杰、刘国臻所编著的《我国土地权利法律制度发展趋向研究——以土地发展权为例》运用物权法理论,从物权的角度进一步探究土地发展权所存在的问题,并按照理论厘定、制度设计等内容为土地发展权法律制度的构建提供了思路。
