正当性是现代版权制度的基石和现代版权理论研究的逻辑起点。版权诞生以降,其法定及适用的正当性即屡被诘疑。微信作为一种网络表达普及之后,它的版权问题也随之受到关注,特别是其版权的正当性尤受质疑,此类质疑所涉范围之广、所触理论之深,均对现有版权理念形成了较大的冲击。论证表明,与以往历次版权危机化解的路径相似,有关微信空间版权正当性的质疑都可以通过对既有理论和制度的调适予以回应和化解。反思微信空间版权正当性,不是为了推翻,而是为了使人类社会这一数百年来渐趋成熟的法制文明成果——版权制度,更加优化,更加深入人心。
Legitimacy is the cornerstone of the modern copyright system and the logical starting point for the study of modern copyright theory. Copyright was born to reduce the legitimacy of its statutory and applicable that has repeatedly been doubted. After the popularity of WeChat as a kind of network, its copyright issues are also paid attention to, especially the legitimacy of its copyright is particularly questioned. The scope of such questions, the depth of theory touched on the existing copyright Idea formed a larger impact. Argumentation shows that, similar to the previous resolution of copyright crises, questions about the legitimacy of WeChat space copyright can be answered and resolved through the adaptation of existing theories and institutions. Rethinking the legitimacy of WeChat space copyright, not to overthrow, but to make human society, a centuries-old achievements of the civilized legal system, the copyright system, more optimized and more popular.
