20世纪西方社会涌现了许多法哲学流派并且热烈讨论了法哲学研究中重点的问题。20世纪西方社会的法学流派中最主要的是新自然法学派、新实证主义法学派和社会学法学派。法学理论和思想与社会经济政治发展有关。不同阶段的历史条件,就会出现与之相适应的法学理论。通过对各家观点的分析研究,有利于充分了解西方发达国家法律制度的思想理论基础,能有助于将来中国的法律继承和法律移植。
In the 20th century, many jurisprudence schools emerged in the western society and heatedly discussed the key issues in the study of jurisprudence. The most important schools of law in the western society in the 20th century were the schools of neo-natural law, the schools of neo-positivists and the schools of sociology of law. Law theory and thought are related to socio-economic and political development. Different stages of the historical conditions, there will be corresponding to the legal theory. Through the analysis and study of various opinions, it is helpful to fully understand the ideological and theoretical basis of the legal system of the western developed countries and to help future Chinese law inheritance and legal transplantation.
