海峡两岸关于航空承运人旅客运输责任制度既有明显差异,又有相通之处。就两岸旅客航空运输责任制度中的责任范围、归责原则、责任限额和航班延误责任制度等理论和实践上的重大问题进行比较研究,既考察实定法具体规定,又考察实践中法院的判例和航空法理论的发展。这一比较研究,对完善我国航空承运人责任制度和旅客消费者保护,修改我国1995年《民用航空法》具有重要参考价值。
Both sides of the Taiwan Strait have clear differences on the air carrier’s responsibility system for passenger transport, as well as similarities. This paper makes a comparative study on the major issues of theory and practice such as the scope of liability, the principle of attribution, the limit of responsibility and the system of liability for delay in the air transportation responsibility system for both sides of the Strait. It not only examines the specific provisions of the actual law but also examines the precedent and The Development of Air Law Theory. This comparative study has an important reference value for improving China’s air carrier responsibility system, protecting passenger consumers, and amending China’s Civil Aviation Law in 1995.
