改革开放以来,我国的法治建设取得了重大进展,行政机关依法行政的能力和水平得到了极大的提高,但也还存在许多急待解决的问题,严重影响了行政机关保障公民权利与自由的职能。因此,在依法治国的宪法原则之下,应当进一步推动法治政府的建设,通过规范、制约和监督行政权的行使来发挥行政机关保障人民权利和自由的功能。
