2002年最高人民法院通过《关于建设工程价款优先受偿权问题的批复》,对《合同法》第286条的适用进行了细化,经过长时间司法实践,对购房消费者主体范围存在很大争议。主要存在购房人权利主体范围不清的问题,法律对如何解释购房“消费者”未做出具体规定。文章立足法理基础层面进行深入探讨,分析《批复》第2条中“消费者”这一权利主体的范围和法理解释,以期对现行立法与司法实践有一定借鉴意义。
