大学生在认为自身权利受学校管理行为的侵犯而要对高校提起诉讼时,究竟应提起民事诉讼还是行政诉讼?这个看似不经意的问题长期困扰着理论界和实务界。本文认为,该问题的解决必须建立在明确高校学生管理权的法律属性基础之上。通过分析,我们将发现,高校学生管理权既具有行政权力的性质又具有民事权利的性质。而是否属于法律、法规明确授权的内容将是界分高校学生管理权的上述两种属性的法律标准。
When college students think that their rights are infringed by school management behaviors and want to institute lawsuits in colleges and universities, should they bring civil or administrative litigation? This seemingly inconvenient problem has long plagued theorists and practitioners. This article argues that the solution to this problem must be based on the legal nature of defining the management power of college students. Through analysis, we will find that the management power of college students not only has the nature of administrative power but also the nature of civil rights. And whether it belongs to the law, law clearly authorized content will be the dividing line of college students management of the above two attributes of legal standards.
