我国的司法解释溯及力目前还不规范,作为人民法院裁决的依据,司法解释需要被重新界定并统一规定,如此才能符合司法的宗旨和法制发展。文章主要探讨了最高人民法院的民商事司法解释的溯及力问题,根据现有的法律条文规定统计并分析出司法解释溯及力的各项规定,并深入探讨法官们对溯及力的解读。通过文章的探讨,帮助人民法院形成更加完善的法律体系。
At present, the retrospective effect of judicial interpretation in our country is not standardized yet. As the basis for the ruling of the people’s court, the judicial interpretation needs to be redefined and unified, so as to be consistent with the purpose of the judiciary and the development of the legal system. This article mainly discusses the retrospective question of judicial interpretation of Civil and Commercial Affairs of the Supreme People’s Court. According to the existing laws and regulations, it stipulates that the provisions of retrospective judicial interpretation should be statisticed and analyzed, and the interpretation of retroactivity by judges should be discussed in depth . Through the discussion of the article, to help the people’s court to form a more perfect legal system.
