在讨论国际经济法问题时,首先必须界定“国际经济法”是一个法律规则体系还是一个学科。作为法律规则体系的国际经济法或者调整国家之间的关系,或者调整私人之间的关系,或者调整国家与私人之间的关系。因此,国际经济法律规则都可以归入(或者说本来就属于)国际公法、民商法、经济法或行政法。从这个意义上说,并不存在独立的国际经济法。但作为一个学科的国际经济法的独立性是应该被承认的。当我们将原先分属不同法律部门的法律规则联系起来进行研究的时候,就有可能提出并论证以前所不曾提出的判断。这些新的判断经过积累并不断地体系化,就会产生出比较完整的国际经济法学。就国际经济法学科体系的界定,我赞同将国际经济法中的民商法成分剥离出去,使其完全成为公法学科。但也不反对任何其他模式的学科界定。学科划分本来是人为的,是为了研究问题的方便。重要的是研究问题。
When discussing the issue of international economic law, we must first define whether “international economic law” is a system of legal rules or a discipline. International economic law, as a legal system of rules, either adjusts the relations between nations or adjusts the relations between private persons or adjusts the relations between the state and private persons. Therefore, the rules of international economic law can be classified as (or belonged to) public international law, civil and commercial law, economic law or administrative law. In this sense, there is no independent international economic law. However, the independence of international economic law as a subject should be recognized. When we study the rules of law that originally belonged to different legal branches, it is possible to present and demonstrate judgments that have not been made before. After these new judgments are accumulated and continuously systematized, they will produce a relatively complete law of international economic law. With regard to the definition of the disciplinary system of international economic law, I agree to divest the components of civil and commercial law in international economic law so that it will become a public law discipline completely. But there is no objection to the disciplinary definition of any other model. Discipline was originally artificial, is to study the convenience of the problem. It is important to study the problem.
