全球化是一个不可逆转的趋势。国际私法回应全球化对国际民商事关系的促进而不断调整自身的规范体系和价值取向。国际私法在漫长的历史发展演变过程中形成了自身的基本理念。国际私法的基本理念既是吸纳、包容人类优秀文化成果的结晶,又是人类优秀文化成果的重要体现。人权作为普世价值为当代国际私法所汲取并被提升为其基本理念。人权价值将在21世纪国际私法中得到彻底的贯彻。这是新世纪国际私法必将出现的新发展趋势。
Globalization is an irreversible trend. In response to the promotion of international civil-commercial relations by globalization, Private International Law constantly adjusts its own normative system and value orientation. Private international law has formed its own basic philosophy in the long evolution of history. The basic idea of private international law is not only the crystallization of absorbing and embracing the outstanding cultural achievements of mankind but also an important manifestation of the outstanding cultural achievements of mankind. As a universal value, human rights are drawn from contemporary private international law and promoted as its basic philosophy. The value of human rights will be fully implemented in the private international law of the 21st century. This is a new trend that will surely emerge in the private international law in the new century.
