商业秘密作为一种具有经济价值的精神财富,其作用日益显现。往往是谁掌握特定的商业秘密、谁就有可能掌握竞争的主动权,以致立于不败之地。同时,商业秘密作为智力成果的重要保护手段,在许多方面弥补了现有知识产权保护制度的某些不足。人们越来越多地以商业秘密为武器保护自己的合法权益,以谋求比现有法律保护下的一般知识产权能获得的更高利润。因此,商业秘密正日益得到人们的重视与青睐。我国颁布的《反不正当竞争法》,对商业秘密及保护作了明确的规定,这无疑为我国市场条件下的交易安全提供了有效的法律保障,弥补了以往法律对商业秘密保护的缺点,促进了我国市场经济运行机制的进一步完善。
As a kind of spiritual wealth with economic value, commercial secrets have become increasingly prominent. Often it is who holds the particular trade secrets, who may have the initiative to control the competition, so invincible. At the same time, as an important means of protecting intellectual achievements, trade secrets make up for some deficiencies in many aspects of the current system of intellectual property protection. More and more people use their trade secrets as their weapon to protect their legitimate rights and interests and seek higher profits than the general intellectual property rights protected by existing laws. Therefore, commercial secrets are increasingly being valued and favored by people. The Anti-Unfair Competition Law promulgated in our country clearly stipulates the trade secrets and protection. This undoubtedly provides effective legal protection for transaction security under the market conditions in our country and makes up for the shortcomings of previous laws on the protection of trade secrets. Promote the further improvement of the market economy operation mechanism in our country.
