自20世纪50年代起我国的法学教学模式一直是以教师为中心的讲授式教学模式,80年代后,该种教学模式开始受到批判和质疑,与此同时,英美法的案例分析教学法得到了追捧,但由于文化环境和法域等的不同,案例分析教学法在我国并没有得到成功的移植。所谓的“案例教学法”只是在讲授过程中穿插有案例分析,只是一种举例法,它所融合的仅是案例教学法的外在形式而已,仍未摆脱传统的以教师为中心的教学模式。真正科学的法学教学模式应是“主导.主体”教学模式。构建“主导.主体”法学教学模式并非简单地体现在选择讲授式教学还是案例教学或是其他方式的教学方法,而是应将发挥教师主导作用和学生主体作用的思想体现在教学的全过程中。
