行政奖励是顺应民主政治和市场经济而勃兴的一种新型行政模式,它能够克服传统的命令—服从模式的不足,最大限度地调动行政相对人实现行政目标的主动性和创造性,既提高了行政效率,又使公民的主体地位受到尊重,体现了深厚的人文主义精神。但是,长期以来,行政奖励在立法、执法和法学研究中不受重视,导致了严重的负效应,其法制化水平亟待提高。因此,本文就完善行政奖励制度的基本思路以及几个有争议的理论问题提出了自己的观点。
Administrative rewards are a new type of administrative mode that is popularized in conformity with democratic politics and market economy. It can overcome the shortcomings of the traditional order-submission mode, and mobilize the initiative and creativity of administrative counterparts to achieve the administrative goals to the maximum extent, Efficiency, but also the citizen’s subject status is respected, reflecting the profound humanism. However, for a long time, administrative rewards have not been taken seriously in the legislation, law enforcement and legal studies, which has led to serious negative effects. The legal system needs to be improved urgently. Therefore, this paper puts forward my own views on how to perfect the basic idea of administrative reward system and several controversial theoretical issues.
