The role of lawyers in criminal procedure in Victoria stems from the nature of the adversarial system,the rules of evidence,and the place of lawyers in the system itself.It is important to place a consideration of the rights of the defendant and the duties of lawyers in the criminal process in the context of the system as it operates as a whole,as the rights and duties of each of the parties derives from the structure and functioning of the system.In this paper I set out briefly the relevant features of the adversarial system,the types of criminal trials and the manner in which criminal guilt is to be proven.
