传统乡村社会中,熟人社会的关系网络决定了调解作为乡土社会纠纷解决的主要方法。伴随着城市化的深入推进,乡村地区原有的社会、经济结构发生了一定形式的变化。这也影响到了乡土社会纠纷及其解决。本文回顾了传统乡村社会纠纷的基本概念及特点,结合一起宅基地纠纷的个案进行法律分析,初步总结出现代乡村社会纠纷解决的多元模式。
In traditional rural society, the network of acquaintances’ social relations determines the main method of mediation as a solution to disputes in the local community. With the deepening of urbanization, some changes have taken place in the original social and economic structures in rural areas. This also affects the local community disputes and their resolution. This paper reviews the basic concepts and characteristics of traditional rural social disputes, and analyzes the legal cases of homestead disputes together with the preliminary analysis of the multiple modes of social disputes settlement in modern rural areas.
