关于行政诉讼证明标准,我国学界一直未有定论。本文从行政诉讼证明标准的概念入手,找寻影响行政诉讼证明标准的因素,对行政诉讼证明标准进行类型划分。同时对行政诉讼法中所规定的“证据确实、充分”标准进行分析,发现其中存在的不合理因素,继而以法律真实为主基调探讨行政诉讼证明标准的多元化发展。
On the proof of administrative litigation, our academic circles have not been conclusive. This article starts with the concept of proof of administrative litigation, finds out the factors which affect the proof standard of administrative litigation, and classifies the proof standard of administrative litigation. At the same time, it analyzes the standard of “evidence is true and sufficient” stipulated in the Administrative Procedure Law and discovers the unreasonable factors in it, and then probes into the diversified development of proof standard of administrative litigation with the law as the keynote.
