在我国现有的立法框架下,引入家事调查官制度不仅能够很好的支撑家事审判改革“解决家庭纠纷,保护未成年人、妇女、老人合法权益”的理念,为多元纠纷解决机制的引入提供辅助支持,还能够灵活地动员社会力量加入到家庭纠纷的解决中来。在未来,本文认为应当将家事调查官制度大力推广到家事审判实践中,为家事审判改革提供有力的支持。
Under the current legislative framework in our country, the introduction of the system of family counselors not only supports the concept of “family dispute resolution” and “protecting the legal rights and interests of minors, women and the elderly”, but also serves as a mechanism for the resolution of multiple disputes The introduction of supplementary support, but also the flexibility to mobilize social forces to join the family dispute settlement. In the future, this paper argues that the system of family counselors should be vigorously extended to the practice of family justice and provide strong support for the reform of family justice.
