当历史上的清官反腐、重典反腐和运动反腐不可能从根本上惩治腐败时,制度反腐便成了人类文明由人治反腐到法治反腐的必然选择。人们不禁要问,既然制度反腐是人类反腐的经验总结和历史选择,在人类几千年的反腐实践中,历朝历代也制定过许多制度,为什么最终都因腐败而亡?改革开放以来,党和政府颁布的制度可以说不胜枚举,为什么腐败仍如此猖獗?改革开放以来颁布的法律制度,之所以对惩治腐败的效果不佳,主要原因有三:
