目前,我国正在起草制定《不动产登记条例》,拟对现行的不动产登记制度进行全面改革和完善。这项立法,全国上下普遍关注,全国公证行业更加关心。因为,不动产公证业务作为一项传统公证业务,在大陆法系国家都是公证的支柱性业务,但在我国,公证对不动产领域的介入非常有限。笔者认为,着眼于构建完善的不动产物权法律制度体系,应当对公证制度给予应有的关注,将公证制度纳入不动产登记制度设计之中。下面,我想从三个方面阐释自己的观点。
At present, our country is drafting and formulating the “Real Estate Registration Regulations”, intending to carry out an overall reform and improvement of the current real estate registration system. This legislation, which is widely concerned throughout the country, is of even greater concern to the notary public in the country. Because real estate notary business as a traditional notary business is not only a notarial pillar business in civil law countries, but in our country, notarization has very limited involvement in the real estate field. The author believes that, focusing on the construction of a sound real estate legal system, due attention should be paid to the notary system, notary system will be included in the real estate registration system design. Below, I want to explain my point of view from three aspects.
