我国对于被害人权利保护的研究还处在发展阶段,将被害人权利问题与我国宪法演变联系起来的论著更是为数不多。经研究,当代中国刑事被害人权利的变迁与宪法的发展有着紧密的关联,被害人权利的逐步加强与“依法治国入宪”、“人权保障入宪”以及“限制权力入宪”是分不开的。目前,我国刑事被害人权利保护仍然面临一些困境,而这些困境的解决都有赖于宪法的进一步发展和宪政的进一步实现。
The research on the protection of victim’s rights in our country is still at the stage of development, and there are only a few articles on linking the question of victim’s rights with the evolution of our country’s constitution. After the study, the vicissitudes of criminal rights in contemporary China are closely linked with the development of the constitution. The victim’s rights are gradually strengthened with the principle of “governing the country into the constitution”, “protecting human rights into the constitution” and “restricting power into the constitution” Is inseparable. At present, the protection of the rights of criminal victims in our country still faces some difficulties, and the solutions to these difficulties depend on the further development of the constitution and the further realization of constitutional government.
