帮教是在我国社会治安综合治理的实践中,由人民群众创造,对特定对象进行帮助教育的一种社会教育管理活动。它在法学中是一个新概念,也是综合治理的重要对策之一。帮教的概念与帮教工作的产生和发展过程,是同社会治安综合治理的概念、方针的产生和发展的过程紧密联系在一起的。党和国家确立综合治理方针的同时,就提出必须对有违法或轻微犯罪的人进行帮助教育。中央(1981)21号文件指出:“对于大量的有轻微违法行为的人,既不要判罪劳改,也不要送去劳教,而是要依靠全党,依靠社会力量,加紧进行教
