每一个国家的宪法都有一定的价值取向。在公民权利与国家权力的关系上,法治发达国家的宪法在文本层面侧重于保护公民权利。我国1954年宪法在特殊的政治、历史与文化背景下,确立了权力本位的价值模式。经过半个多世纪的演化,我国宪法的价值取向出现了新的变化,建设和谐社会的理念,确立保障公民权利的价值模式正成为我国宪法的明显趋势。
Each country’s constitution has a certain value orientation. In the relationship between civil rights and state power, the Constitution of the developed countries in the rule of law focuses on the protection of civil rights at the text level. Under the special political, historical and cultural background, the 1954 Constitution of our country established the value model of power standard. After more than half a century of evolution, the value orientation of our country’s constitution has undergone a new change. The idea of building a harmonious society and the establishment of a value model for safeguarding citizens’ rights are becoming an obvious trend in our country’s constitution.
